These Terms of Service ("Terms") govern your access to and use of Talmaara (the "Service"), operated by Savage Gamez, LLC, a limited liability company organized under the laws of the State of Maine, United States ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. The Service is not directed to, and is not intended for use by, children under the age of 13, and if you are under 13 you may not register for or submit any personal information to the Service. By using the Service, you represent that you meet this requirement and that the information you provide is accurate. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account that results from your failure to safeguard your credentials.
Certain features of the Service require a paid subscription. By subscribing, you authorize us and our payment processor to charge the applicable fees to your selected payment method.
You may cancel your subscription at any time from your billing page or through the Stripe billing portal. When you cancel, your paid access continues until the end of the current billing period, after which your account reverts to the free tier. Except as described below or where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods.
14-day money-back guarantee. Every new subscription comes with a 14-day money-back guarantee: if you request a refund within 14 days of starting a new subscription, we refund the full amount you paid and end your plan, with no deduction for the time you had access. This is in addition to ordinary cancellation, which remains available at any time. EU and UK consumers also have a statutory 14-day right of withdrawal; this guarantee meets and exceeds it by refunding you in full. Plans sold as a one-time purchase carry a 30-day money-back guarantee instead. Full details, including how to withdraw and a model withdrawal form, are set out in our Refund & Withdrawal Policy.
The Service, or parts of it, may be offered as a beta or early-access release. Such features are provided "as is", may be incomplete or change without notice, and may be modified or discontinued at any time. We make no guarantee that beta features will be supported, retained, or made generally available.
You agree not to:
You retain all ownership rights in the worldbuilding, written, and other content you create or upload to the Service ("Your Content"). You grant us a limited, non-exclusive license to host, store, process, and display Your Content solely as necessary to operate and provide the Service to you. We do not claim ownership of Your Content and we do not use it for advertising or sell it to third parties.
You are solely responsible for Your Content and for ensuring you have the rights necessary to use it. We recommend keeping your own backups of important work.
The Service itself — including its software, design, branding, and original text — is owned by Savage Gamez, LLC and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or branding without our prior written consent.
We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms or engage in conduct that we reasonably believe is harmful to the Service, other users, or us. You may stop using the Service and delete your account at any time. Upon termination, your right to use the Service ceases immediately; provisions that by their nature should survive termination will survive.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any data will not be lost.
To the maximum extent permitted by law, Savage Gamez, LLC and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or one hundred US dollars ($100), whichever is greater.
You agree to indemnify and hold harmless Savage Gamez, LLC from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.
These Terms are governed by the laws of the State of Maine, United States, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Maine, and you consent to personal jurisdiction in those courts.
We respect intellectual-property rights and expect users to do the same (see Section 8 on your responsibility for content you upload).
Reporting infringement. If you believe content on the Service infringes your copyright, send a written notice to our designated agent — Copyright Manager, Savage Gamez, LLC, at support@talmaara.com. To be effective under the U.S. Digital Millennium Copyright Act (DMCA), your notice must include: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the infringing material and information reasonably sufficient to locate it (such as a URL); (d) your name, address, telephone number, and email; (e) a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and (f) a statement, made under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act on the owner's behalf. Knowingly misrepresenting that material is infringing may create liability under Section 512(f).
What happens next. On receiving a notice that substantially complies with the above, we will act expeditiously to remove or disable the material and make a reasonable effort to notify the user who posted it.
Counter-notification. If your content was removed by mistake or misidentification, you may send our agent a counter-notice that includes: (a) your physical or electronic signature; (b) identification of the removed material and where it appeared before removal; (c) a statement, under penalty of perjury, that you have a good-faith belief it was removed as a result of mistake or misidentification; and (d) your name, address, and telephone number, your consent to the jurisdiction of the U.S. Federal District Court for your district (or, if your address is outside the United States, any district in which we may be found), and your agreement to accept service of process from the complainant. If we receive a valid counter-notice, we may restore the material in 10 to 14 business days unless the complainant notifies us they have filed a court action.
Repeat infringers. In appropriate circumstances, we suspend or terminate the accounts of users who are determined to be repeat infringers.
We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
